The key thing is - collusion to commit a crime. Did you collude with the criminal to create a crime. No, you had no contact or knowledge of the criminal act..
Also... be careful asking a regulator if they think you should be regulated. Fair bet they will say 'why of course you should be regulated'.. self regulation is a dangerous thing IMO
However one interesting outcome of the fact we are even having to talk about this is Network information should certainly be unrecoverable by a 3rd party by design ( even by the network operator ) Apple is learning this the hard way right now.
